Van Nuys DUI Attorney

Van Nuys DUI Attorney

A Van Nuys DUI Attorney is essential to your legal defense if your case will be handled at the Van Nuys Courthouse.  The location of your arrest determines the location of the courthouse. The courthouse, which has a jail, is located at 14400 Erwin Street Mall in Van Nuys.  It is open from 7:30 am to 4:30 pm Monday through Friday.  The following is a list of holidays for which the court is closed:

  • New Year’s Day
  • Martin Luther King, Jr. Birthday
  • Lincoln Day
  • Presidents Day
  • Cesar Chavez Day
  • Memorial Day
  • Independence Day
  • Labor Day
  • Columbus Day
  • Veterans Day
  • Thanksgiving Day
  • Day after Thanksgiving
  • Christmas Day

DUI Cost

The fines issued by the court is $390 plus penalty assessments which will balloon up to approximately $2,000.  The court will give you time to pay the fine; or in the alternative, you may elect to convert the fine to community labor or jail time.  You will also incur costs to attend the alcohol program which will be required as part of your probation with the court, and also required in order to get a restricted license from DMV.

DMV Admin Per Se

When you get arrested and charged with a DUI, you essentially will have two separate concurrent cases as a result of the arrest.  You have the criminal case that requires you to go to court.  You also have a civil case against you from the DMV.  They are separate cases arising out of the same set of facts.  The DMV will begin proceedings to have your driving privilege suspended as a result of your DUI.  The DMV does not care what happens with your court case.  In fact, even if your criminal case is reduced to something other than a DUI, the DMV may still find you in violation of driving under the influence and suspend your license.

You are exposed to jail time anywhere 48 hours to 6 months in custody.  Typically, in Los Angeles County, the court and the prosecutor will accept the “time served” in custody and will not require any additional jail time.  If you were involved in an accident, have prior DUI convictions and/or you are minor, the prosecutor may demand some jail time.
